They are not spyware by public information, but they have access to everything and they are closed source. I think it's only reasonable to assume they could be used for that. Regarding the BSD comment, I've met many incredibly skilled individuals on the dark web who have used OpenBSD for years and swear by it. At a certain skill level it's less about that and more about how you configure it.
